Terms of Service

These terms are an agreement between you and Berwick Labs LLC (“we”, “us”) about your use of SitterSorted. By creating an account, or by replying YES to a SitterSorted opt-in text, you agree to them. If you don't agree, please don't use SitterSorted. SitterSorted™ is a trademark of Berwick Labs LLC.

What SitterSorted is, and what it isn't

SitterSorted is a scheduling and messaging tool. It helps families send babysitting, pet sitting, and house sitting requests by text to sitters they already know, in an order the family chooses, and keeps track of who said yes.

• We don't find, recommend, screen, interview, or run background checks on sitters. Families add sitters themselves and decide who to ask and book.
• We don't employ sitters. Sitters are not our employees, contractors, or agents. Any arrangement for care is solely between the family and the sitter.
• We don't process or hold payments to sitters. Pay is arranged directly between the family and the sitter. Payment tracking and links to third-party apps (such as Venmo) are a convenience only.
• We make no promises about any sitter's qualifications, conduct, or availability, or that a request will be filled.

Accounts

• You must be at least 18 to create a parent account.
• You may invite another adult, such as a co-parent, to your household. Everyone in a household can see and manage its sitters, requests, and bookings.
• Keep your sign-in secure and tell us right away if you think someone else has accessed your account.

Your responsibilities as a parent

• Only add a person as a sitter if they have agreed to be added and to receive babysitting, pet sitting, and house sitting requests from you by text through SitterSorted. Sitters must be at least 13. If a sitter is under 18, only add them if their parent or guardian has agreed.
• Give accurate booking information, and keep your house information up to date.
• You are responsible for choosing your sitters and for any arrangements, pay, and legal obligations (such as tax or employment rules for household workers) between you and them.
• Don't use SitterSorted to send messages unrelated to sitting requests, or to message people who haven't agreed.
• If you connect an AI assistant, you're responsible for the requests it posts or cancels with your approval, just as if you had done it in the app. You can disconnect it at any time.

SMS terms

Program: SitterSorted sends text messages to sitters on behalf of the families who added them. Messages include a one-time opt-in request, babysitting, pet sitting, and house sitting requests, booking confirmations, reminders, cancellations, and replies to sitter texts.

Parent alerts: parents can also choose to get texts about their own household's sitter requests (babysitting, pet sitting, and house sitting, including overnight and multi-day stays) from a separate SitterSorted number. A parent opts in by entering their own mobile number in Settings and checking a consent box, then replying YES to one opt-in text; no alerts are sent before that YES. Alerts cover bookings, requests that reach the last sitters or find no one free, cancellations by another parent in the household, day-before reminders, amounts owed to a sitter, and replies about requests a parent texts in. Parents can turn texts off in Settings at any time.

• Consent: A sitter receives a single opt-in text when a family adds them, and gets no requests until they reply YES (or text JOIN with a family's code). Each family sends its own opt-in. A parent gets no alerts until they reply YES to their own opt-in text.
• Message frequency varies depending on how often families send requests and how many bookings they have.
• Message and data rates may apply.
• To opt out, reply STOP (or UNSUBSCRIBE, CANCEL, END, or QUIT) to any message. You'll get one confirmation and then no more texts from that SitterSorted number. For sitters, that covers every family. Sitter requests and parent alerts come from different numbers, so each STOP applies to the number you reply to. Reply START to opt back in.

• Carriers are not liable for delayed or undelivered messages.

• We don't sell or share mobile numbers or opt-in information for marketing. See our Privacy Policy.

Subscriptions and billing

• New households get a free trial. No payment method is needed to start it.
• After the trial, you can subscribe monthly or yearly at the prices shown on our website, or continue on a free plan with limited features.
• Subscriptions renew automatically until cancelled. You can cancel any time in your account settings, and your plan stays active until the end of the period you paid for. Except where required by law, payments are not refundable.
• We'll give you advance notice before changing prices for an active subscription.
• Referrals: a household that signs up with another household's referral link gets 30 extra days of free trial. Once it has paid at least one month and 14 days have passed without a refund or dispute, the referring household gets a credit equal to one month of the monthly plan on its next bill, or 30 more trial days if it hasn't subscribed yet. Each new household can be referred once, and a household can earn up to 12 credits a year. Credits have no cash value, can't be transferred, and are forfeited if the household is deleted. Referring your own household earns nothing. We may change or end the program, and may withhold credits earned through fake or duplicate accounts.
• SitterSorted is always free for sitters.

Acceptable use

You agree not to:

• Harass anyone, or send unlawful, threatening, or misleading messages.
• Add phone numbers without the owner's permission, or try to get around opt-outs.
• Try to access other households' information, or disrupt or reverse engineer the service.
• Use SitterSorted for any purpose other than coordinating childcare with people you know.

Your information

You keep ownership of the information you add. You give us permission to store and use it to run SitterSorted, as described in our Privacy Policy.

Third-party services

SitterSorted links to or relies on services from other companies, such as calendar apps and payment apps. Your use of those services is governed by their own terms.

Disclaimers

SitterSorted is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied. We don't guarantee that messages will be delivered on time or at all, that a sitter will respond, or that the service will be uninterrupted. We are not responsible for the acts or omissions of any family or sitter.

Limitation of liability

To the fullest extent the law allows, we won't be liable for any indirect, incidental, special, or consequential damages, or for any harm arising from care arrangements between families and sitters. Our total liability for any claim related to SitterSorted is limited to the greater of the amount you paid us in the 12 months before the claim or $100.

Indemnity

You agree to defend and hold us harmless from claims arising from your use of SitterSorted, the sitters you add or book, or your violation of these terms.

Ending your use

You can stop using SitterSorted and delete your account at any time. We may suspend or end access if you violate these terms or misuse the service.

Changes to these terms

If we make material changes, we'll update the date above and notify parents in the app or by email before they take effect. Continuing to use SitterSorted after that means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Maryland, without regard to its conflict of law rules. Any dispute with Berwick Labs LLC about SitterSorted will be resolved in the state or federal courts located in Baltimore County, Maryland, and you and Berwick Labs LLC agree to the jurisdiction of those courts. Before filing a claim, please email help@sittersorted.com so we can try to resolve it informally.
